Fachin says abuse of religious authority unbalances elections


The Minister of Supreme Federal Court (STF) and vice-president do Superior Electoral Courtal (TSE) Edson Fachin said on Monday, 10, it is possible to recognize the abuse of religious authority, “In a rare and exceptional character”, within the scope of the current legislation. The TSE should judge, on Thursday, the possibility of revoking a political mandate by abuse of religious power.

During an event promoted by the France-Brazil Chamber of Commerce (CCIFB), Fachin he assessed that the existence of a state, “in which a given religious belief or formation is emphasized”, attacks a broader sense of democracy.

“The first question to be answered is whether it is possible, through interpretation, to understand that the sense of electoral legitimacy is violated when a certain religious authority, taking advantage of its status of supremacy over the faithful, instead of promoting dialogues about platforms, ideas or programs, carries out a kind of extortion of consent, causing in fact an abusive direction on account of its authority for a given candidacy ”, said the vice president of the TSE.

According to the minister, this would unbalance equality and conditions of dispute in a given election. “The second question that I tried to answer, and I believe that there is not much divergence, is to show that the dimension of the religious integrates the sense of identity of each one”, said the minister.

The minister met, by videoconference, last week with members of the Evangelical Parliamentary Front who criticized him for legal activism in defending the issue. Fachin said of the meeting that there was a fruitful dialogue. “We need more dialogue in Brazil even to know where the dissent is,” he said.
